How are oaths divided if some heirs are women who are barred from swearing?
Chapter on Qasamah (Oaths regarding murder)
Al-Mughni
Book of Blood-Money (Diyyāt)
Primary text
If some of those involved are women, who are entirely barred from the Qasamah, their status is disregarded. If the heirs consist of a son and a daughter, the son swears the entire fifty oaths. If the heirs consist of a full brother and a uterine sister, and a consanguine brother and a uterine sister, the oaths are divided between the two full brothers: three oaths for the uterine brother and eight for the other, totaling eleven. The remainder is then rounded up, resulting in the consanguine brother swearing thirty-seven oaths and the uterine brother swearing fourteen oaths.
