Primary text

There are two established opinions regarding the payment schedule for partial blood money. One view dictates that it must be divided and paid over three years, as it is a substitute for a life (Nafs), thereby resembling full blood money. The opposing view holds that the first installment must equal one-third of the full blood money, and the remainder is paid in the second year. This latter view argues that since this amount is less than the full Diyya, it should not be divided over three years, similar to the compensation for a limb injury (Arsh al-Taraf). This second view is the established position of Abu Hanifa, and it corresponds to one of the two views held by Al-Shafi'i.

The secondary opinion is that the payment should be spread over two years, with the first year covering one-third of the full Diyya, and the rest in the second year. This division is based on the amount being less than the full Diyya.
