Qasamah is not established if a Muslim is wounded, apostatizes, and dies in that state of apostasy. This is because his life is not legally guaranteed (non-guaranteed) anymore; only the injury itself is guaranteed, and Qasamah is not established for injuries less than life itself. Furthermore, the apostate's wealth becomes Fai' (spoils of war without a specified heir), and since Fai' has no specific entitled recipient, Qasamah cannot be established for it.
