What is the required compensation for involuntary seminal discharge following rape or illicit sexual intercourse under dubious circumstances (shubha)?
Chapter on Diyat (Blood Money) for Wounds
Al-Mughni
Book of Blood-Money (Diyyāt)
Primary text
If seminal fluid is discharged involuntarily from a woman who was coerced into adultery or from one who was sexually penetrated under a misconception of legitimacy (shubha), and the discharge is complete, the perpetrator must pay both the full blood money (diyah) and the dowry (mahr). This is based on general legal principles derived from the context concerning injuries.
