What is the ruling on the compensation for a fetus if the religion of the non-believing parents differs?
General Chapter
Al-Mughni
Book of Blood-Money (Diyyāt)
Primary text
If the parents of the fetus are non-believers adhering to different religions (e.g., a Christian father and a Magian mother, or vice versa), the compensation is assessed based on the one whose blood money is greater. Therefore, one-tenth of the blood money of the one whose Diyya is higher is obligatory in all cases. This aligns with the principle applied when a fetus is the offspring of a Muslim woman and a disbeliever, where the standard is set by the higher blood money value.
