What is the ruling on Diyah if the tongue is partially cut, resulting in total loss of speech, and a second injury removes the remainder, after which speech returns?
Chapter on Diyat (Blood Money) for Wounds
Al-Mughni
Book of Blood-Money (Diyyāt)
Primary text
If a person cuts half of a tongue, causing complete loss of speech, and then another person cuts the remaining part, and speech subsequently returns, the Diyah does not need to be returned. This is because the speech that was tied to the original tongue has departed, and its return occurred in a different location (a new tongue structure), distinguishing it from the case where the original faculty returns to the original location.
