What is the ruling if the heir validates only the testimony of the second pair of witnesses (the accused individuals) and invalidates the first pair?
Chapter on Qasamah (Oaths regarding murder)
Al-Mughni
Book of Blood-Money (Diyyāt)
Primary text
If the heir validates only the second pair (the accused individuals) and invalidates the first pair, the testimony of all parties becomes void. The testimony of the first pair is nullified due to the heir invalidating them and their retraction of what they initially testified to. The testimony of the second pair is not accepted because they are adversaries to the first pair and are defending themselves against harm through their testimony.
