What is the ruling if an individual apostatizes before the death of the person whose estate is in question?
Chapter on Qasamah (Oaths regarding murder)
Al-Mughni
Book of Blood-Money (Diyyāt)
Primary text
If a person apostatizes before the death of his ancestor (the deceased), he is not considered an heir and has no rights. The right to Qasamah transfers to the other living heirs. If the deceased has no other heir besides the apostate, then no Qasamah is established, based on the ruling concerning the apostate heir.
