Primary text

For injuries to a female slave that have not reached one-third of the Diyah, the compensation is the Diyah stipulated for a male slave because both male and female slaves are considered equal in this regard. If the injury exceeds one-third, such as the severing of a hand, the compensation is three-quarters of the Diyah for a male slave's hand (equivalent to thirty-seven and a half camels). Retaliation (*qawad*) is applicable for both male and female slaves in such instances, as they do not differ regarding physical retaliation, and the injurer can be retaliated against by either. If the act was intentional, the injurer owes half the Diyah of a freeman and half the slave's value. If it was an error, the injurer owes half the slave's value, and the *aqilah* (kinsmen of the injurer) owes half the Diyah.

Supporting text

When the injury reaches the level of Diyah, such as severing the nose or both hands, the entire compensation for the severed hand falls upon the injurer's personal wealth because half the hand’s Diyah (due to the slave's partial freedom) amounts to one-quarter of the full Diyah, which is less than one-third of the Diyah. Additionally, one-quarter of the slave's market value is due from the injurer.
