What is the ruling if the reinserted tooth, after growing back, is pulled out again by someone?

Chapter on Diyat (Blood Money) for Wounds

Book 48 · Issue 2 · Bab 2

Primary text

If the same tooth, which had previously grown back after reinsertion, is pulled out a second time, its full compensation (diyah) becomes obligatory. This is because the tooth is now considered an established tooth possessing beauty and utility, necessitating the payment of its full value, as if it had never been pulled out initially.

Supporting text

Al-Qadi's ruling depends on the initial obligation to remove the tooth. If removing the tooth was obligatory (e.g., due to corruption), the first assailant incurs no penalty for having removed what should have been removed. If removal was not obligatory, a full dihya might be due, or perhaps only a *hukumat*, or potentially no liability if the dihya was already owed once and should not be owed a second time.
