What is the ruling if the severance of a woman's nipples causes cessation of lactation?

Chapter on Diyat (Blood Money) for Wounds

Al-Mughni

Book of Blood-Money (Diyyāt)

Book 48 · Issue 6 · Bab 2

Open in Qurani

Primary text

The full *diya* is due if severance causes the loss of lactation, as the utility is removed, comparable to the loss of fingers on a palm or the glans of the penis. The rationale is that the child drinks and nurses through them, thus equating them to fingers on a hand.

Supporting text

If both breasts are severed entirely, only the *diya* of the breasts is due, as in the case of severing the entire penis. If a penetrating wound (*ja'ifah*) results from the severance, one-third of the *diya* of the penetrating wound is due in addition to the breasts' *diya*. If two penetrating wounds result, the due amount is one *diya* and two-thirds of a *diya*.
