What is the ruling if a woman's breasts are injured causing paralysis without severance?
Chapter on Diyat (Blood Money) for Wounds
Al-Mughni
Book of Blood-Money (Diyyāt)
Primary text
If the breasts are struck and paralyzed, the full *diya* is incumbent, similar to the paralysis of both hands.
Supporting text
If the injury diminishes lactation without causing paralysis, our companions hold that a discretionary indemnity (*hukuma*) is due. This aligns with the view of Al-Shafi'i's companions. An alternative view suggests the full *diya* is due because the utility has been lost, making it similar to paralysis. This alternative is the apparent view of Malik, Al-Thawri, and Qatada. If a minor injury is inflicted and she later gives birth without lactation, expert testimony is sought. If experts determine the injury caused the cessation of milk, the same liability applies as if lactation ceased after its presence. If they state the milk would cease without the injury, no indemnity is due, as the default position is acquittal from liability, and doubt does not establish liability.
