What happens if the evidences presented by the two slaves in the illness scenario contradict each other?
General Chapter
Al-Mughni
Book of Claims and Evidences
Primary text
There are two possible outcomes when the evidences contradict: one is drawing lots between them because when evidences nullify each other, one is prioritized by lot in one narration. The second is preferring Salem's evidence because it testifies to an increase in certainty, namely, recovery (al-bur').
Supporting text
If the heirs admit the claim for one slave, that slave is freed by their admission, and the right of the other is not nullified unless two trustworthy witnesses, free from suspicion, testify to that effect, in which case the claimant with the witnesses is freed alone if the other has no evidence.
