If the value of one enslaved person equals one-third of the estate and the other is less, and the one valued at one-third (or the one chosen by lot if dates are concurrent) is freed, the other remains enslaved. If the one valued less than one-third is chosen, they are freed, and sufficient value is taken from the second to complete the full one-third bequest for manumission.
