Are *Fay'* (spoils of war without fighting) and *Ghanīmah* (booty taken in battle) treated the same regarding the distribution of Khums (one-fifth)?

The distribution (*masraf*) and ruling (*hukm*) concerning *Fay'* and *Ghanīmah* are identical, and there is no disagreement on this point among those who mandate Khums for both. This consensus is established by divine decree in two texts: Allah states concerning what is taken in general, "And know that whatever you take of anything, then indeed for Allah is one-fifth of it..." (Quran 8:41), and regarding *Fay'*, Allah states, "What Allah has allotted to His Messenger from the people of the towns..." (Quran 59:7) in the verse, and the designated recipients mentioned in both verses are the same.
