Does the authorization for a wife to divorce herself, when instructed by 'Divorce yourself,' lapse immediately (is it confined to the assembly)?
Chapter on Explicit Divorce and Others
Al-Mughni
Book of Divorce
Primary text
The authorization given to the wife to divorce herself when told 'Divorce yourself' is not restricted to the immediate assembly (majlis); rather, it is a continuous delegation (tawkeel) in divorce, which remains effective until acted upon, similar to the delegation to a non-relative. This view is supported by analogy with the phrase 'Your affair is in your hands' (Amruki bi-yadiki), which is not immediately lapsed.

Al-Qadi held that this authorization is restricted to the assembly because it is a delegation to her, analogous to saying 'Choose' (Ikhtari), which is a choice (takhyeer) rather than a delegation in the sense of agency.
