Is divorce established if the husband says 'Anti Mutallaqah' (You are decreed/released)?
Chapter on Explicit Divorce and Others
Al-Mughni
Book of Divorce
Primary text
If the husband intends by 'Anti Mutallaqah' that she was divorced by a past divorce, or divorced from a previous husband, nothing is incumbent upon him. If he did not intend anything specific, there are two opinions: one holds that divorce occurs, and the other holds that it does not occur. The explicitly stated position from Ahmad is that it is explicit and divorce occurs because it is a derivation of the word 'Talaq,' similar to 'Anti Taliqu.'
Supporting text
The statement that 'Anti Mutallaqah' is not explicit suggests it resembles other ambiguous terms, as there is no established usage or religious convention for it being exclusive to divorce. However, the explicit ruling from Ahmad maintains it is explicit because it is derived from the explicit word 'Talaq'.
