The effect of the physical medium of the divorce letter being damaged or destroyed.
Chapter on Explicit Divorce and Others
Al-Mughni
Book of Divorce
Primary text
If the writing is erased by rubbing or other means, but the paper itself reaches her, she is not divorced because what reached her is not considered the written divorce decree. Similarly, if the writing becomes illegible due to moisture or other causes, the divorce does not occur because the writing itself constitutes the divorce communication. However, if the margins are damaged or a part tears off, but the remaining part still constitutes the writing, and it reaches her, the divorce occurs because the remaining part is still considered the writing.
Supporting text
If a portion of the text containing the divorce statement tears off and is lost, but the rest of the paper arrives, she is not divorced because the essential subject matter (the declaration of divorce) has been lost, even if the remaining part is still physically paper.
