Can a husband retract or accelerate a divorce conditional upon a future time?
Chapter on Explicit Divorce and Others
Al-Mughni
Book of Divorce
Primary text
If a husband makes the divorce conditional upon a future time and then states, 'I hasten that specific divorce for you now,' the divorce does not take immediate effect. This is because the divorce is already suspended by a specified future time, and the husband has no means to alter that appointed time prematurely.
Supporting text
If the husband intends to expedite a divorce other than the stipulated one, one divorce occurs immediately. If the stipulated time arrives while the wife is still under his marriage bond, the conditionally suspended divorce takes effect at that time.
