What is the legal ruling if a husband states fractional amounts without specifying the unit of divorce, such as 'half, a third, and a sixth'?
Chapter on Divorce by Calculation
Al-Mughni
Book of Divorce
Primary text
If the husband states, 'You are divorced by half, a third, and a sixth' (نصفا وثلثا وسدسا), only one divorce occurs, as these are understood to be the parts that constitute one divorce, unless he intends a part from each divorce, in which case three divorces occur.
Supporting text
If the husband says, 'You are divorced by half, a third, and a quarter' (نصفا وثلثا وربعا), two divorces occur because the stated fractions exceed one full divorce by one-sixth, which is then completed.
