Primary text

If the husband intends divorce when using the figurative phrase, the divorce occurs without the wife needing to have an intention for it, because the husband suspended the divorce upon an act from her, similar to saying, 'If you speak, you are divorced,' and she spoke. Abu Hanifah holds this position.

The correct view holds that since the pronouncement is a figure of speech resulting in divorce, it requires her intention, just as it required the husband's intention. Furthermore, if she intends three divorces, three fall, because the act of choosing itself does not admit a specific number, similar to the choice of a freed slave.
