What is the ruling according to Abu Hanifa when a husband states, 'You are divorced, one talaqa in two', regardless of his intention regarding calculation?
Chapter on Divorce by Calculation
Al-Mughni
Book of Divorce
Primary text
According to Abu Hanifa, only one divorce occurs, whether he intended calculation or not, unless he intended 'one with two'. This is because multiplication (darb) is valid only for things possessing dimension, and calculation has no reality for things without dimension; thus, only the dissolution in one occurs, not the rest.
Supporting text
The opinion supporting the view that the wording is established in their convention to mean two divorces, so if uttered and left unrestricted, it takes effect as if he said, 'You are divorced, two'. This perspective distinguishes itself from Shafi'i's view by asserting that the established wording does not require intention. However, if the speaker is ignorant of the numerical implication established by calculation experts, only one divorce occurs, as the effective word for dissolution is just 'one', and the extension to two is based on their convention.
