What is the ruling when a husband says to four wives, 'I have cast between you five divorces'?
Chapter on Divorce by Calculation
Al-Mughni
Book of Divorce
Primary text
If the husband states, "I have cast between you five divorces" (أوقعت بينكن خمس طلقات), each woman receives two divorces. This is the position of Al-Hasan, Qatadah, Al-Shafi'i, Abu Thawr, and the Ahl al-Ra'y. The justification is that the share for each woman is one and a quarter divorces, which is then completed (rounded up or completed to the nearest whole number based on this context). This ruling applies similarly if he states six, seven, or eight divorces.
Supporting text
If he states, "I have cast between you nine divorces" (أوقعت بينكن تسعا), they are divorced three times each.
