What is the ruling if a speaker, known to use 'fi' to mean 'ma'a' (with), utters 'You are divorced, one talaqa in two'?
Chapter on Divorce by Calculation
Al-Mughni
Book of Divorce
Primary text
If the speaker is known by people to mean 'with' when using 'fi' here, then three divorces occur because his speech is carried according to their custom, and its apparent meaning indicates his intent, which is immediately understood from his statement.

If the speaker intended the legal implication understood by calculation experts, the ruling is that the implication is not binding upon him, similar to an Arab uttering divorce in a foreign language without knowing its meaning. This is the view of most Shafi'i companions because if he does not know the implication, he did not intend to enact it, and intending what one does not know is invalid.
