What is the ruling when a speaking person says 'You are divorced' and gestures with three fingers?
Chapter on Explicit Divorce and Others
Al-Mughni
Book of Divorce
Primary text
If a speaking person says, 'You are divorced' (Anti Talik) and gestures with three fingers, only one divorce occurs because the gesture is insufficient on its own to establish the count.
Supporting text
If the speaker says, 'You are divorced, like this,' and gestures with three fingers, the divorce is threefold, because the phrase 'like this' explicitly links the count to the fingers, serving as clarification, supported by the precedent of the Prophet (peace be upon him) indicating the length of the month with his fingers.
