When must the sighting of the crescent moon occur for the condition of divorce to be met?
Chapter on Explicit Divorce and Others
Al-Mughni
Book of Divorce
Primary text
The sighting is contingent upon seeing the crescent moon after sunset. If it is sighted before sunset, divorce does not occur because the crescent of the month was not yet established at that time, and the sighting is interpreted as signifying the entry into the first night of the month.
Supporting text
It is possible that divorce occurs upon sighting it before sunset, as it is still called a sighting, and a religious ruling is associated with it in the Sharia.
