Why does the *Mahr al-Mithl* vary based on the woman, unlike other valuations of destroyed property?
General Chapter
Al-Mughni
Book of Dowry (Mahr)
Primary text
The *Mahr al-Mithl* differs from general valuations of destroyed property because marriage is intended for the specific persons of the spouses, causing variation based on their individual characteristics. In contrast, other destroyed items are primarily valued financially and do not differ based on the specifics of what was destroyed. Moreover, general valuations do not vary based on custom, but the *Mahr* does vary according to local customs. If a woman belongs to a group accustomed to light dowers, her *Mahr* must be light, even if she is superior in standing or honor to women from groups accustomed to heavy dowers. Custom must be followed if it involves factors such as nobility or financial standing.
