What is the ruling regarding the dowry when the man or woman is ignorant of the prohibition or the *iddah* status?
General Chapter
Al-Mughni
Book of Dowry (Mahr)
Primary text
If either the man is ignorant of the prohibition of intercourse in this situation, or the woman is ignorant that she is in *iddah* or that the marriage is forbidden, then the *mahr* is due to her, as the intercourse is considered a case of doubtful law (*shubhah*).
Supporting text
A narration from Abu Dawud states that the Prophet, peace be upon him, awarded *mahr* to a woman married by Basrah ibn Aktham, who gave birth four months after the marriage. Another narration states she is due the *mahr* for the part of her honor that was legally utilized, and she is to be flogged upon giving birth.
