Whose testimony prevails in a dispute over whether the husband taught the required portion of the Quran?

General Chapter

Book of Dowry (Mahr)

Book 36 · Issue 2 · Bab 1

Open in Qurani

Primary text

If the parties disagree, the wife's statement prevails, asserting that no teaching occurred, because the original presumption is the absence of teaching. However, there is another view stating that if the disagreement occurs after the wife has learned the material, the husband's word prevails because the apparent situation supports his claim (that she now knows it).

Supporting text

If the husband taught her the Surah (chapter) and she subsequently forgets it, he owes nothing further because he has fulfilled his stipulated condition. The dower is only invalidated after possession has taken place.
