What is the classification of watermelon concerning the term 'fruit'?

There are two differing opinions regarding watermelon. One view holds that it is fruit because it ripens and sweetens, resembling tree fruit. This is the position of Al-Qadi and Al-Shafi'i and Abu Thawr.

The second view maintains it is not fruit because it is the produce of a vine (*baqlah*), thus resembling cucumbers and small gourds.
