Is an oath to not wear fabric spun by a specific woman broken if the garment is mixed with others' spun fabric?
General Chapter
Al-Mughni
Book of Expiations
Primary text
If a person swears not to wear anything spun by a specific woman (Fulanah), and then wears a garment composed of her spun material mixed with material spun by others, the oath is broken (Hanth). This view is held by Al-Shafi'i. This is based on the interpretation that the oath applies even if the item is partially derived from the specified source.
Supporting text
There are two narrations regarding an oath not to wear a garment entirely of her spun material when the garment is mixed: one states the oath is broken (Hanth), consistent with the first ruling. The second narration states the oath is not broken (La Hanth), a position held by Abu Hanifa and Al-Shafi'i, because the person did not wear a garment entirely made from her spinning.
