If the buyer knows of the defect but frees the slave without taking the Arsh, the Arsh belongs to the emancipator (the buyer). This is because he emancipated the slave while fully aware of the defect, thus forfeiting the right to the Arsh, similar to a situation where he sold the slave without knowledge of the defect (implying the buyer in the sale context would have a right to the Arsh if he didn't know, but here the context suggests the current owner has forfeited his right).
