If sexual intercourse occurs after the testimony confirming the start of Ramadan, the individual is liable for both making up the day's fast (Qada) and incurring the expiation (Kaffarah), similar to one who begins the day without the intention to fast or one who intentionally breaks the fast before intercourse.

If the sexual intercourse occurred before the confirmation (evidence) of Ramadan was established, the ruling reverts to that of someone who broke their fast believing dawn had not yet broken when it had, following the established rulings for that specific scenario.
