If two individuals sight the moon but do not testify before the judge, it is permissible for those who know their justice to break the fast based on their testimony, according to the Prophet's saying: "And when two testify, then fast and break the fast." Similarly, if the judge rejects their testimony due to not knowing their status, those who know their justice may still break the fast, as the judge's rejection here is a suspension due to lack of knowledge, not a final ruling.

If one person knows the justice of the other, but the other does not know the first's justice, breaking the fast is not permitted for him unless the judge rules, lest he breaks the fast based on his own solitary sighting.
