It is never permissible for the Imam to seek assistance from non-believers in fighting the rebels, nor from those who permit killing the rebels even when they are retreating (mudbirin). This is the position of Al-Shafi'i.

Supporting text

The proponents of Al-Ra'y hold that it is permissible to seek assistance from the Dhimmis, the Musta'minin (those granted temporary safe conduct), and another category of people, provided that the people of justice are the dominant party among those being sought for assistance.
