What is the ruling on liability when the offense necessitates a monetary payment less than the value resulting from the confession of servitude?
General Chapter
Al-Mughni
Book of Foundlings
Primary text
If the offense necessitates a monetary payment less than the value derived from the confession of servitude, the lesser of the two amounts is obligatory. If the amount is equal to the obligation before the confession, the full amount is due and paid to the victim's master. If the due amount would be greater because the perpetrator's value as a slave exceeds his value as a free person (implying the standard compensation as a free person), only the Arsh for an offense against a free person is due.
Supporting text
Whoever accepts the confession in all legal matters mandates the Arsh for the offense against the slave.
