If the Umm Walad dies before her master, does the ruling of her status regarding her child's manumission upon the master's death remain effective?
General Chapter
Al-Mughni
Book of Freeing Mothers of Children
Primary text
If the Umm Walad dies before her master, the ruling of her status regarding her child does not become void, and the child is manumitted upon the master's death because the cause (the establishment of her status) was not nullified; rather, freedom is confirmed for the child because the mother no longer remains the subject of that ruling.
Supporting text
Similarly, the ruling concerning the child of a Mudabbara is not voided by the death of the mother. However, if the Mukataba dies, her child reverts to being a slave because the contract is nullified by her death, leaving no effect of the contract upon the child.
