Primary text
The ruling of martyrdom applies equally to adults and non-adults. This position is held by Al-Shafi'i, Abu Yusuf, Muhammad, Abu Thawr, and Ibn al-Mundhir. The supporting evidence is that the individual was a Muslim killed fighting alongside the polytheists in combat, thus resembling an adult. Furthermore, they resemble adults in the requirements for prayer over them and their washing if they were not killed by the polytheists. Examples include Harithah ibn al-Nu'man and 'Umayr ibn Abi Waqqas, who were minors among the martyrs of Uhud, and the general nature of the relevant hadith covers all such cases. The view that they are excluded is refuted by considering the ruling for women.

Abu Hanifah holds that the legal status of a witness does not apply to a non-adult because they are not considered fit for combat.
