Primary text

If the sick person recovers before the proxy finishes the Hajj, the Hajj performed by proxy should not suffice, as the sick person became capable of performing the original act before the substitute was completed. Therefore, the original obligation falls upon him. This is analogous to a minor or a woman whose menstruation ceased when they experience the relevant event (menstruation/puberty) before completing their waiting period counted in months, or the one performing Tayammum when water becomes available during his prayer.

Supporting text

There is an opinion that the Hajj performed by proxy suffices in this case, analogous to the Mutamatti' (one performing Umrah and Hajj during the same season) who begins fasting after being capable of offering the sacrificial animal (hady), or one seeking expiation who begins the substitute act after becoming capable of the original required action.
