Primary text

If the designation of the specified animal substituting an obligation is nullified, and the animal reverts to its owner, there are two possibilities regarding its offspring. One possibility is that the designation in the offspring is also nullified as a consequence, similar to its attached increase (نمائي متصل). The sounder view is that the designation in the offspring is not nullified. Instead, the offspring belongs to the poor, because it followed the mother in obligation while physically attached to her, but it does not follow the mother in the removal of the obligation because it became physically separated from her. This is analogous to the offspring of a sold, defective item returned to the seller—the sale of the item itself is voided, but the sale regarding its offspring remains valid. Similarly, if an enslaved person designated for manumission upon the master's death (Muddabbir) kills their master, nullifying the manumission decree, this nullification does not affect the status of their offspring.
