If the agent, instructed to perform Hajj, performs Tamattu' (Umrah followed by Hajj) or performs Umrah for himself from the Miqat and then performs Hajj, the Hajj is valid if he proceeds to the Miqat and assumes the Ihram for Hajj from there. No penalty is incurred. This position is affirmed by Ahmad and constitutes the school of Shafi'i.

If the agent assumes the Ihram for Hajj from Mecca instead of the Miqat, a sacrificial penalty (dam) is due for neglecting the designated Miqat. Furthermore, the agent must return the portion of the expenses corresponding to the distance between the Miqat and Mecca, as this part of the contract was left unfulfilled regarding the Hajj Ihram.
