Primary text

It is permissible to delay shaving or shortening the hair until after the time of sacrifice (Nahr). This is permissible because if delaying the sacrifice itself, which precedes shaving/shortening, is allowed, then delaying the latter is even more appropriate. This view is supported by Ata, Abu Yusuf, and Abu Thawr, and resembles the opinion of Al-Shafi'i. The evidence cited is the verse stating the beginning of the time for this action: "And do not shave your heads until the Hady reaches its destination" (Quran 2:196). Since the ending time was not specified, performing the act whenever it is done suffices, similar to the Tawaf of Ziyarah and the Sa'i. Furthermore, it is an act of worship delayed until its time of permissibility, making it analogous to Sa'i.

Supporting text

If the shaving or shortening is delayed beyond the time of the sacrifice, there are two narrations regarding the consequence. One opinion is that no penalty (blood sacrifice/dam) is due. The opposing narration from Ahmad, which aligns with the Madhhab of Abu Hanifah, states that a penalty (dam) is obligatory for the delay because leaving any required ritual (nusuk) necessitates a penalty.
