Primary text

The Hadiths permitting the taking of payment or fees (Ja'l/Ujrah) pertain specifically to Ruqyah, which is treated as a distinct, specific case (Qadiyyah in an instance). In contrast, building mosques is not exclusive to those qualified for Qurbah and can be done with or without the intention of worship. If building a mosque is done for wages, it ceases to be an act of worship, and the intention cannot be divorced from worship in this context; thus, performing worship for a wage invalidates it.

Permissibility of taking sustenance (Nafaqah) does not necessitate the permissibility of taking wages (Ujrah). This is evidenced by judging (Qada'), giving testimony (Shahadah), and leading prayer (Imamah), for which stipends are provided from the public treasury (Bayt al-Mal)—which is sustenance in meaning—yet taking specific wages for them is impermissible.
