What are the legislated circuits (Tawaf) related to Hajj, and what is their legal status?
Chapter on the Description of Hajj
Al-Mughni
Book of Hajj
Primary text
There are three legislated circuits in Hajj: Tawaf Al-Ziyarah (Tawaf of the Visit), which is an obligatory pillar (Rukn) of Hajj, and Hajj is incomplete without it, concerning which there is no scholarly disagreement. Tawaf Al-Qudum (Tawaf of Arrival) is Sunnah, and abandoning it incurs no penalty. Tawaf Al-Wada' (Farewell Tawaf) is obligatory, and abandoning it requires compensation with a blood sacrifice (Dam). This view is held by Abu Hanifah, his companions, and Ath-Thawri.
Supporting text
Malik holds that abandoning Tawaf Al-Qudum requires a blood sacrifice, but abandoning Tawaf Al-Wada' incurs no penalty. A view narrated from Ash-Shafi'i aligns with our position regarding Tawaf Al-Wada' and with his position regarding Tawaf Al-Qudum.
