What is the liability for consuming or disposing of Hady meat improperly?
Chapter on Ransom (Fidyah) and Penalty for Hunting
Al-Mughni
Book of Hajj
Primary text
If one eats from the Hady what they were forbidden to eat, they are liable to replace it with the like in meat, because the entirety of the animal is guaranteed as the like in animal form, so its parts follow suit. Similarly, if one gives a portion to the butcher, they are liable to replace it with the like. If one gives meat to a wealthy person as a gift, it is permissible, analogous to the Udhiyah, because what one is permitted to eat, one is permitted to gift.
Supporting text
If one sells or destroys a portion, they are liable to replace it with the like, as this is prohibited, similar to giving it to the butcher. If a non-related person destroys a portion, they are liable for its value, as the destroyer is liable for the value of something not present in kind, like destroying the meat of a specific person.
