From which location must a person perform the make-up (Qada') of Ihram if they violated the state of Ihram?

The performance of the make-up Ihram for a violation must originate from the farther of two locations: either the designated Miqat (boundary for entering Ihram) or the person's initial place of assuming Ihram. This is because if the Miqat is farther, one is prohibited from crossing it without being in Ihram. If the initial place of Ihram is farther, the obligation of assuming Ihram for the make-up is established from that farther point. This view is stated by Ahmad, and it is narrated from Ibn Abbas, Sa'id ibn al-Musayyib, Al-Shafi'i, and Ishaq, and chosen by Ibn al-Mundhir. The basis for this ruling is that the make-up of a ritual is analogous to its performance, similar to prayer.

Al-Nakh'i holds that the make-up Ihram must be performed from the location of sexual intercourse ('mawdi' al-juma') because that location represents the place where the violation (فساد) occurred.
