Primary text

Whoever travels a route that contains a Miqat, that Miqat becomes their Miqat. For example, a Syrian traveling for Hajj via Madinah passes Dhu al-Hulayfah, which becomes their Miqat. If a Syrian travels for Hajj via Yemen, the Miqat is Yalamlam. If they travel via Iraq, the Miqat is Dhat 'Irq. This applies to everyone who passes a Miqat other than the designated Miqat for their home area; that encountered Miqat becomes binding upon them.

Al-Shafi'i and Ishaq hold that the general ruling applies based on the Prophet's statement: 'They are for them, and for those who pass them by from other than their own people.' Abu Thawr and the Ahl al-Ra'y permit the Syrian passing Madinah to assume Ihram from Al-Juhfah. 'A'ishah used to assume Ihram for Hajj from Dhu al-Hulayfah and for Umrah from Al-Juhfah, perhaps arguing that the Prophet (PBUH) designated Al-Juhfah for the people of Sham.
