Is a penalty incumbent upon one who is not in the state of Ihram?

The penalty (*Jaza'*) is only obligatory upon one who is in the state of Ihram. This ruling applies equally to the Ihram for Hajj and the Ihram for Umrah, based on the comprehensive nature of the textual evidence concerning both states. There is no scholarly disagreement on this point. Furthermore, there is no distinction made regarding the penalty whether one enters Ihram for a single ritual (*Nasik*) or for two rituals simultaneously (the *Qarin*), as God Almighty did not differentiate between these two situations.
