Primary text

The permissible time (time of sufficiency) for throwing the Jamarat begins at midnight of the night of the Sacrifice. This view is held by 'Ata', Ibn Abi Layla, 'Ikrimah bin Khalid, and Al-Shafi'i. The evidence for permissibility before sunrise is provided by a narration from Abu Dawud where the Prophet (peace be upon him) ordered Umm Salamah on the night of the Sacrifice to throw the Jamarat al-'Aqaba before dawn, and then proceed to perform Tawaf. It is argued that since this period is designated for departing Muzdalifah, it should also be a time for stoning, analogous to the time after sunrise. Previous reports concerning rising after sunrise are understood to indicate desirability (Istihbab).

Supporting text

Ahmad narrated that throwing after Fajr before sunrise suffices. This is the position of Malik, Ahl al-Ra'y, Ishaq, and Ibn al-Mundhir. Mujahid, Al-Thawri, and Al-Nakha'i maintained that stoning should only occur after sunrise, based on the previously cited Hadith.
