What is the prescribed time for slaughtering the Hady of Tamattu'?
Chapter on the Description of Hajj
Al-Mughni
Book of Hajj
Primary text
The prescribed time for slaughtering the Hady of Tamattu' is the Day of Sacrifice (Yawm al-Nahr). This view is held by Malik and Abu Hanifa. The reasoning is that slaughtering is impermissible before the Day of Sacrifice, and thus, slaughtering the Hady of Tamattu' is also impermissible before this day, analogous to the prohibition of slaughtering before exiting the Ihram of Umrah.

Ata' stated that the obligation (and implicitly, the time for slaughter) is when the pilgrim performs the stoning of the Jamarat. Al-Khattab held a similar view, stating it becomes obligatory at the break of dawn on the Day of Sacrifice, as that is the time of slaughter. Regarding early slaughter, Ahmad stated that if a person arrives in Mecca during Shawwal with a Hady, he should slaughter it in Mecca, even if he arrives before the first ten days of Dhul Hijjah, provided the animal is not lost or stolen. Ata' agreed with this. However, if the pilgrim arrives during the ten days (of Dhul Hijjah), he should not slaughter it until he slaughters in Mina, following the example of the Prophet (peace be upon him) and his Companions. If someone slaughters before that time for their Umrah, they remain in their state of Ihram and are considered a Qarin (one performing both rites simultaneously).
